Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of FUPAYME, the website and progressive web application at fupayme.hockey (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. About FUPAYME

FUPAYME is a tool for organizing recreational hockey pickup games. The Service helps organizers create events, manage roster caps and waitlists, and coordinate fee-free peer-to-peer payments through third-party apps (Venmo and Cash App). FUPAYME is not a payment processor and does not hold, transmit, or guarantee funds.

2. Eligibility

You must be at least 13 years old to use the Service. By using FUPAYME, you represent that you meet this requirement and that the information you provide is accurate and current.

3. Accounts

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity under your account.
• You must provide a valid email address and phone number where required for league participation.
• We may suspend or terminate accounts that violate these Terms or misuse the Service.

4. League Participation and Payments

• Event fees, roster rules, and league policies are set by organizers, not by FUPAYME.
• When you secure a roster spot, you may enter a pending payment window. Failure to pay within the stated time may result in losing your spot and waitlist promotion to another player.
• Payments are made directly between you and organizers via Venmo or Cash App. FUPAYME provides deep links and QR codes only; we are not a party to those transactions.
• Organizers verify payments manually. Disputes about payment amounts, refunds, or attendance are between you and your league organizer.

5. SMS Text Messaging Terms

By providing your mobile phone number and checking the SMS opt-in box during account setup (or enabling SMS in Settings), you consent to receive transactional automated text messages from FUPAYME triggered by real-time league activity. We do not send marketing or promotional SMS blasts. Message types include:

• New and updated skate announcements
• Waitlist promotions when a spot becomes available
• Payment reminders and payment confirmation notices
• Event cancellation notices

Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

Opt-out: Reply STOP to any message to unsubscribe from SMS. Reply START to re-subscribe. Reply HELP for assistance, or email support@fupayme.hockey. You may also disable SMS in Settings → SMS Notifications.

Opting out of SMS does not affect email or push notifications unless you disable those separately. Some account-related communications may still be sent by email as needed to operate the Service.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Harass, abuse, or harm other users
• Provide false contact information or impersonate others
• Attempt to gain unauthorized access to the Service or other accounts
• Scrape, reverse engineer, or overload the Service
• Use the Service to send spam or unsolicited commercial messages

7. Organizer Responsibilities

If you are granted organizer or admin access, you are responsible for fairly administering events, verifying payments accurately, and communicating with your league members. Organizers must only use member contact information for legitimate league-related purposes.

8. Intellectual Property

The Service, including its design, code, and branding, is owned by FUPAYME and protected by applicable intellectual property laws. You may not copy, modify, or distribute the Service without permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

FUPAYME is a scheduling and coordination tool. We are not responsible for injuries, property damage, no-shows, payment disputes, or any conduct at pickup games or off the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUPAYME AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (TYPICALLY ZERO, AS THE SERVICE IS FREE) OR (B) ONE HUNDRED U.S. DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless FUPAYME from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect and use personal information, including phone numbers for SMS.

13. Changes to These Terms

We may modify these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may be communicated by email or in-app notice. Continued use after changes constitutes acceptance.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access for violation of these Terms or for any reason with notice where practicable. Sections that by their nature should survive (disclaimers, limitations of liability, indemnification) will survive termination.

15. Governing Law

These Terms are governed by the laws of the United States and the State in which FUPAYME operates, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of competent jurisdiction in that State, unless applicable law requires otherwise.
